Can you build an ADU in Montgomery County, MD?

Yes. Montgomery County allows one accessory dwelling unit (ADU) per lot on properties with a single-family detached home, either attached (a basement or addition) or detached. A DHCA rental license is required and the owner must occupy the main home or the ADU. Under ZTA 26-06 — the county's update to comply with Maryland HB 1466, expected to take effect on or around October 1, 2026 — an ADU can be up to 75% of the size of the primary home (a major increase over the old 1,200 sq ft cap), ADUs are allowed in more zones, detached setbacks drop to standard accessory-structure setbacks, and parking requirements are reduced. Makara ADU handles design, permits, and construction — move-in ready in as little as 120 days from permit approval.
Know the Rules

Montgomery County ADU Guidelines

The rules that decide whether, and what, you can build. The table below carries the specifics.

Size Limits

Up to 75% of Your Home

ZTA 26-06 replaces the county's old size caps with a single state standard: an ADU — attached or detached — may be no greater than 75% of the size of the primary home. For most houses that is well above the former 1,200 sq ft limit, though accessory-structure height, lot-coverage, and stormwater rules still cap the practical footprint.

Zoning & Eligibility

Single-Family Lots Countywide

One ADU is permitted per lot on properties with a single-family detached home. ZTA 26-06 expands the zones where ADUs are allowed as a limited use so the county complies with state law, and excludes ADUs from density calculations in all zones.

Setbacks (ZTA 26-06)

Accessory-Structure Setbacks

Effective on or around Oct 1, 2026, a detached ADU must meet the same side and rear setbacks as any other accessory structure. This strikes the county's earlier rule — a 12-foot rear setback plus an added setback for units wider than 24 feet — making tighter lots easier to build on.

Parking (ZTA 26-06)

Requirements Reduced

ZTA 26-06 reduces ADU parking mandates to comply with state law. Under the prior rule, one extra off-street space was required — waived within one mile of a Metro, Purple Line, or MARC station. Confirm the current requirement for your specific address with DPS.

Occupancy & License

Live On-Site + DHCA License

The owner must occupy either the main home or the ADU as a primary residence, and a rental license from the Department of Housing & Community Affairs (DHCA) is required before the ADU is rented or occupied. Current code limits the ADU to no more than two adult occupants.

Permits & Safety

DPS Permit + Sprinklers

ADUs are approved administratively through the Department of Permitting Services (DPS) — no special exception since 2013. Newly built detached ADUs generally require fire sprinklers, and properties in a historic district need a Historic Area Work Permit (HAWP).

Side and rear minimums are the accessory-structure setbacks from Montgomery Planning's development-standards zoning fact sheets . Corner-lot (side-street) setbacks are typically 15 ft (20 ft in RE zones), and a separate rule limits the cumulative footprint of all accessory buildings to 50% of the principal building's footprint or 600 sq ft, whichever is greater. Detached-ADU height follows the accessory-structure height limit for the zone. Last verified August 2026 — confirm your lot's requirements with Montgomery County DPS.

How It Works

The Montgomery County ADU Permit Process

  1. 01

    Zoning & Eligibility

Confirm your zone, lot size, footprint and lot-coverage limits, and setbacks under ZTA 26-06. Makara ADU does this free with our property eligibility checker.

  2. 02

    Design & Drawings

Architectural and structural plans to Montgomery County code — fire-sprinkler design and, where applicable, a Historic Area Work Permit (HAWP) — plus the ADU and driveway drawings the Class 3 application requires.

  3. 03

    Class 3 Application (DHCA)

File the application with proof of residency, drawings, and fees. DHCA accepts it, the public-notice sign goes up, and an initial inspection leads to the Director's preliminary report — construction can't start until it's complete.

  4. 04

    DPS Permits & Build

Building and trades permits from the Department of Permitting Services; construction proceeds after the preliminary report, with county inspections along the way.

  5. 05

    Final Inspection & License

Housing Code's final inspection and the Director's final report; the Class 3 license is approved about 30 days later — keys in hand, ready to occupy or rent.

Common Questions

Montgomery County ADU FAQ

Can I build an ADU in Montgomery County, MD?

Yes. Montgomery County permits one ADU per lot on properties with a single-family detached home, either attached (a basement or addition) or detached. ADUs are approved through the Department of Permitting Services (DPS), and a DHCA rental license is required before the unit is rented or occupied.

How big can a detached ADU be in Montgomery County?

Under ZTA 26-06, an ADU — attached or detached — may be up to 75% of the size of the primary home , replacing the county's earlier caps (the least of 1,200 sq ft, 50% of the home's footprint, or 10% of the lot). Accessory-structure height, lot-coverage, and stormwater limits still apply, so they can further constrain a detached unit.

What is ZTA 26-06 and when does it take effect?

ZTA 26-06 is Montgomery County's zoning text amendment updating its ADU rules to comply with Maryland HB 1466 / SB 891. It raises the ADU size limit to no more than 75% of the primary home (replacing the old 1,200 sq ft / 50% footprint / 10% lot caps), expands eligible zones , excludes ADUs from density calculations in all zones, lowers detached-ADU setbacks to the standard accessory-structure setbacks, and reduces parking requirements. It is expected to take effect on or around October 1, 2026 , the state-mandated deadline.

Do I need a license to rent out my Montgomery County ADU?

Yes. The county requires a rental license from the Department of Housing & Community Affairs (DHCA) before an ADU is rented or occupied, and the owner must occupy either the main home or the ADU as a primary residence. Do I need a Class 3 license before I build an ADU in Montgomery County? Yes — the process starts before construction. You file the Class 3 application with DHCA first; construction can't begin until DHCA completes its preliminary inspection report, and the license itself is issued after a final inspection. It's required whether or not you rent the ADU.

Do I need the license if the ADU is for family, not a rental?

Yes. Montgomery County requires the Class 3 license whether the ADU is rented or not — aging-in-place and multigenerational living included. Short-term rentals and Airbnb are not permitted.

How much does the Class 3 ADU license cost?

$615 at submission — a $260 filing fee, a $230 public-notice sign fee, and a $125 annual license fee. Properties in the City of Takoma Park pay $490, since the rental license there is handled by the city.

What are the setback rules for a detached ADU in Montgomery County?

Under ZTA 26-06, effective on or around October 1, 2026, a detached ADU must meet the same side and rear setbacks as any other accessory structure . This replaces the county's earlier rule, which required a 12-foot rear setback plus an added setback for units wider than 24 feet.

What are the ADU setbacks for my zone in Montgomery County?

A detached ADU uses the accessory-structure side and rear setbacks for its zone. In the most common ADU zones that is roughly: RE-2 / RE-1 — 15 ft side, 10 ft rear; R-200 — 12 ft side, 7 ft rear; and R-90, R-60, and R-40 — 5 ft side and 5 ft rear. Corner lots, older recorded lots, and larger structures can change what applies — check your exact standards on Montgomery Planning's zoning fact sheets or with DPS.

Do I need extra parking for an ADU in Montgomery County?

Parking requirements are being reduced under ZTA 26-06 to comply with state law. Under the prior rule, an additional off-street space was required, though it was waived within one mile of a Metro, Purple Line, or MARC station. Confirm the current requirement for your address with DPS.

Do ADUs need fire sprinklers, and what about historic districts?

Newly built detached ADUs generally require fire sprinklers. Properties within a designated historic district also need a Historic Area Work Permit (HAWP) and design review, which adds time to the permitting schedule.

How much does a Montgomery County ADU cost, and how long does it take?

A turnkey one-bedroom / one-bathroom detached ADU typically runs from about $250,000 to $350,000 depending on size, site, and finishes; basement and garage conversions cost less. See the size-by-size breakdown above. A Makara ADU can be move-in ready in as little as 120 days from permit approval.
